Poaflix Terms & Conditions
Effective Date: May 15, 2025

Welcome to Poaflix! These Terms and Conditions ("Terms") govern your use of the Poaflix OTT streaming platform and services (the "Service") in Tanzania. By creating an account or using Poaflix, you agree to be bound by these Terms, as well as our Privacy Policy and any other guidelines we may provide. If you do not agree, please do not use Poaflix.

This document is divided into two parts: Part I applies to general users and subscribers of Poaflix, and Part II applies to content creators who upload or contribute content to Poaflix. Content creators are also Poaflix users, so both Part I and Part II apply to them. Please read both sections carefully if you are a content creator.

Part I: Terms for General Users and Subscribers

1. Account Creation and Access
• Eligibility: You must be at least 18 years old (or the age of majority in your region) to create a Poaflix account. Minors may only use Poaflix under the supervision of a parent or legal guardian, who agrees to be bound by these Terms on the minor's behalf vodacom.co.za.
• Account Registration: When creating an account, you agree to provide accurate, current, and complete information. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. Notify us immediately of any unauthorized use or security breach. Poaflix is not liable for any loss or damage arising from your failure to safeguard your account.
• Account Usage: Your account is personal to you. You agree not to share your login details with others outside your household or allow others to access the Service using your credentials. Poaflix may limit the number of simultaneous devices or streams per account according to your subscription plan (if applicable).

2. Subscription, Payments, and Refunds
• Subscription Plans: Poaflix offers subscription-based access to its content. By subscribing, you gain access to Poaflix content library as per your plan. Details of available plans (such as monthly or annual subscriptions, number of screens, HD/UHD access, etc.) and their pricing are provided on the Poaflix website or app.
• Billing and Payment: You must provide a valid payment method (e.g., mobile money, credit/debit card, or other accepted methods) and authorize Poaflix to charge the subscription fee to that method. Billing Cycle: Subscription fees will be charged in advance on a recurring basis (e.g., monthly on the calendar day you subscribed). If a payment fails due to expiration or insufficient funds, Poaflix may suspend your access until you update your payment method and the charge is successful vodacom.co.za. You are responsible for any applicable taxes or transaction fees in addition to the subscription price.
• Auto-Renewal: Your subscription will automatically renew at the end of each billing cycle unless you cancel. Poaflix will continue to charge your payment method on a recurring basis until you cancel.
• Cancellation: You may cancel your subscription at any time via your Account settings. Cancellation will take effect at the end of your current paid period; you will retain access to the Service until that billing period expires vodacom.co.za. To the extent permitted by law, payments are non-refundable, and Poaflix will not provide refunds or credits for partially used subscription periods or unwatched content vodacom.co.za. This means if you cancel mid-month, you will not receive a pro-rated refund for the rest of that month.
• Changes to Fees or Plans: Poaflix may change subscription fees or introduce new plans. Such changes will be communicated to you with at least 30 days' notice and will apply only after the notice period. If you do not agree to a fee change, you may cancel your subscription before the new fee takes effect.
• Free Trials and Promotions: If Poaflix offers a free trial or promotional period, those are subject to these Terms as well. We reserve the right to determine eligibility for free trials and to modify or terminate them at any time. After a free trial ends, your subscription will auto-renew and begin billing unless you cancel before the trial ends.

3. Acceptable Use Policy
When using Poaflix, you agree to do so lawfully and respectfully. You may access and use the Service for personal, non-commercial entertainment purposes only vodacom.co.za. In using Poaflix, you are NOT allowed to:
• Unauthorized Copying or Distribution: You shall not reproduce, record, stream (outside the Service), publicly display, transmit, or distribute Poaflix content except as allowed by the Service's features. All content is for your personal viewing only, and any form of public performance or sharing of your login for others to watch is prohibited. vodacom.co.za
• Circumvention and Tampering: You shall not attempt to circumvent or disable any content protection or digital rights management (DRM) measures used by Poaflix. This includes not removing, altering, or bypassing security technology that protects content. You also agree not to use any robot, spider, scraper, or other automated means to access the Service or gather content/data without our prior written permission. vodacom.co.za
• No Reverse Engineering: You shall not decompile, reverse engineer, disassemble, or attempt to derive source code from the Poaflix platform, apps, or any of our software. vodacom.co.za
• Prohibited Content/Behavior: You agree not to upload, post, or transmit any content (such as comments, chat, or user interactions, if applicable) that is unlawful, harmful, defamatory, obscene, infringing, hateful, or which encourages illegal activity. You also must not introduce any malware, viruses, or harmful code onto the Service.
• Respect for Others: You shall not harass, threaten, or abuse other users, and you must not engage in any behavior that interferes with any other subscriber's use and enjoyment of Poaflix.
• Compliance with Laws: You agree to use Poaflix in accordance with all applicable laws and regulations of Tanzania and any other jurisdiction that applies. You are responsible for ensuring your use does not violate any laws (for example, regarding copyrighted material or offensive content).

Violation of this Acceptable Use Policy may result in immediate suspension or termination of your account, at Poaflix's discretion, without notice. Poaflix reserves the right to take appropriate legal action for illegal or unauthorized use of the Service. vodacom.co.za

4. Content Access and Restrictions
• License to Use Content: As a subscriber, Poaflix grants you a limited, non-exclusive, non-transferable, revocable license to access and view the content made available on the platform within Tanzania (or other authorized service regions) for your personal, non-commercial use. Except for this limited license, no right, title, or interest in the content is transferred to you. You agree not to use the content for any public performances or commercial purposes.
• Geographic Limits: Poaflix content is primarily licensed for viewers in Tanzania. Attempting to access content from outside Tanzania (if not officially supported) by using VPNs or other technical means may violate these Terms. Poaflix may use geo-blocking to ensure content is only viewed in permitted regions, and you agree not to circumvent these measures. Content availability can vary by region and may change over time.
• Device Limits: The number of devices on which you can simultaneously stream Poaflix content may be limited by your subscription plan (e.g., standard vs. premium plans). Please refer to your specific plan details. You agree not to exceed the authorized streams or create multiple accounts to circumvent device or stream limits.
• Content Ownership: All movies, series, videos, games, and other content on Poaflix are owned by Poaflix, its parent company (Mambo Media Ltd), or third-party licensors. Content is protected by copyright and other intellectual property laws. You shall not download, copy, or save content (other than within any offline viewing feature provided by Poaflix, if available) and you may not remove or alter any copyright notices. Any unauthorized use of content may infringe copyright and result in civil or criminal liability.
• Offline Viewing: If Poaflix offers a feature to temporarily download content for offline viewing, such content is subject to limitations (e.g., viewing within a certain time, not transferable to other devices, etc.). Those downloads are for personal use only and remain governed by these Terms; you must delete any offline content if your subscription ends or if Poaflix removes that content from the platform.
• Content Changes: The selection of content on Poaflix will change from time to time. Poaflix reserves the right to add or remove content, and to update, enhance, or otherwise modify the Service and its features at its discretion. We make no guarantee that any particular content will be available on the Service at any given time.

5. Privacy and Data Protection
• Personal Data: Poaflix collects and processes personal data from users in accordance with its Privacy Policy (available on our website). We are committed to protecting your privacy and handling your personal information in compliance with Tanzanian law, including the Personal Data Protection Act, 2022 (PDPA), as well as applicable international data protection standards. • Use of Data: By using Poaflix, you agree that we can collect and use technical data and related information (including but not limited to improve our Service and provide you with updates, support, and other services. We also use cookies or similar technologies to enhance user experience, as detailed in our Privacy Policy.
• User Communications: We may send you service-related communications (e.g., account verification, payment confirmations, technical and security notices). These are considered part of the Service. For marketing communications, we will obtain any consent required by law, and you can opt-out as permitted.
• International Transfer: Poaflix primarily stores and processes data in Tanzania. If we transfer your data outside of Tanzania (for example, to a service provider or server in another country), we will ensure such transfer is done in accordance with legal requirements for data protection and that adequate safeguards are in place.
• Rights of Users: Subject to applicable law, you may have the right to access, correct, or delete your personal data held by Poaflix. You may contact us as described in the Privacy Policy to exercise these rights or if you have any privacy-related questions or complaints. Poaflix will not sell your personal data to third parties, and we do not share personal data with third parties for their direct marketing unless you give consent.
• Privacy Policy: Please review our Privacy Policy for full details on how we collect, use, disclose, and protect your information. The Privacy Policy is incorporated into these Terms by reference. If Poaflix needs to materially change how we handle personal data, we will notify users and, if required, seek consent.

6. Limitation of Liability
• Service Provided "As Is": Poaflix is provided to you on an "as is" and "as available" basis without warranties or conditions of any kind, either express or implied. We do not guarantee that the Service will be uninterrupted, error-free, or free of viruses or other harmful components vodacom.co.za. While we strive for a high quality experience, we make no warranty regarding the quality, accuracy, or reliability of the content or the Service.
• No Indirect Damages: To the fullest extent permitted by law, Poaflix (including its parent company, officers, directors, employees, and agents) will not be liable to you for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, loss of data, or loss of opportunities, even if we have been advised of the possibility of such damages vodacom.co.za. You agree to waive all special or consequential damages or remedies against us to the extent allowed by applicable law. vodacom.co.za
• Cap on Liability: To the extent permitted by law, the total liability of Poaflix for any claim arising out of or relating to these Terms or your use of the Service, regardless of the form of the action, shall not exceed the amount of subscription fees you paid to Poaflix in the three (3) months immediately prior to the event giving rise to the claim. If you have not paid any fees, Poaflix's maximum liability will be limited to $50 (or the equivalent in Tanzanian Shillings). vodacom.co.za
• User Responsibility: You assume full responsibility for any damages or losses that result from your use of the Service, including any content accessed or any dealings with other users. Poaflix is not responsible for the conduct, whether online or offline, of any user of the Service.
• No Third-Party Liability: Poaflix's content may include material from third-party licensors or links to third-party sites (e.g., embedded content or advertising). Such third parties are not liable for any claims arising from your use of the Service. Likewise, Poaflix takes no responsibility for content on third-party websites that may be linked from our platform.
• Non-Excludable Rights: Nothing in these Terms is intended to exclude or restrict any warranty or liability that cannot be excluded by law. If the laws of Tanzania or your jurisdiction do not allow the exclusion of certain warranties or liabilities, those statutory provisions will apply. However, in such case, Poaflix's liability will be limited to the maximum extent permitted by law.

7. Dispute Resolution and Governing Law
• Governing Law: These Terms and any dispute arising out of or in connection with them or the use of the Service are governed by the laws of the United Republic of Tanzania. This choice of law does not deprive you of any consumer protections under the law of your residence that by law cannot be waived.
• Informal Resolution: We encourage you to contact Poaflix Customer Support first to attempt to resolve any issues informally. Often we can find a quick solution if you experience any problems or have a disagreement with us.
• Jurisdiction: In the event of a dispute that cannot be resolved amicably, you agree that the dispute will be subject to the exclusive jurisdiction of the courts of Tanzania. The primary venue shall be the courts located in Dar es Salaam, Tanzania, unless another location is required by applicable law. You and Poaflix consent to personal jurisdiction in these courts.
• Arbitration (if chosen): At Poaflix's sole discretion, we may elect to resolve any dispute through binding arbitration in accordance with the arbitration laws of Tanzania. If arbitration is elected, we will notify you, and the arbitration shall be conducted by a reputable arbitration body in Tanzania, in the English language. Each party will bear its own costs, and the arbitrator's decision shall be final and binding, with limited rights of appeal.
• Class Action Waiver: To the extent permitted by law, you agree to resolve disputes with Poaflix only on an individual basis, and not as a representative or member of a class. You waive any right to participate in any class-action lawsuit or class-wide arbitration against Poaflix.
• Time Limit on Claims: To the extent permitted by law, any cause of action or claim you may have arising out of or relating to these Terms or the Service must be commenced within one (1) year after the cause of action accrues, otherwise such cause of action is permanently barred. kids.youtube.com

8. Termination
• By You: You may stop using Poaflix and/or close your account at any time. If you wish to delete your account, you can follow the procedures on the platform or contact customer support. Termination of your account will be effective after any ongoing subscription period ends (unless we terminate for cause in which case access may end immediately).
• By Poaflix: We reserve the right to suspend or terminate your account or access to the Service at any time if you breach these Terms, violate applicable law, or engage in behavior that is unlawful or harmful to others or to Poaflix's interests. In most cases, we will provide notice to you of the termination or suspension, and where appropriate, the reason for it. However, we may terminate or suspend without notice if we reasonably believe it is necessary (for example, a serious violation or urgent situation).
• Effect of Termination: Upon termination of your account, whether by you or by us, your right to access the Service and any content ceases. We may immediately deactivate your account and delete or restrict access to your content. If you were a subscriber, you will not be entitled to any refund for the remaining period of a subscription (except where required by law or as explicitly provided in these Terms).
• Survival: Any provisions of these Terms which by their nature should survive termination (such as limitations of liability, governing law, dispute resolution, and indemnity obligations) shall continue to remain in effect after your use of the Service ends.
